SUPERIOR, WI (KDAL) – Superior Water Light and Power (SWL&P) has sued the City of Superior regarding the language of a ballot proposal in April of next year.
The City Council approved the ballot question that asks voters if the City of Superior should acquire the water utility if it falls within the city’s financial means.
The lawsuit says the language of the ballot question will be misleading and confusing to voters on whether a “yes” vote would be binding or advisory in nature.
The suit asks the court for a permanent injunction that would require the removal of the ballot question in its current form from the April ballot.
In response to the lawsuit, Superior Mayor Jim Paine says it is an obvious attempt to take the decision away from the voters and tells SWL&P that “we’ll see you in court.”
